These Terms govern access to and use of the EasySyncPOS website, applications and related services. By creating an account or using the service, you agree to these Terms.
1. Service operator
EasySyncPOS is operated by APDSoftware, Advanced Programs Developers, Via C. Colombo 15, 24047 Treviglio (BG), Italy, P.IVA 03835250162, REA BG 431224 (“APDSoftware”, “we”, “us”). Contact: info@easysyncpos.com.
2. Eligibility and accounts
You must have legal capacity to enter into a contract and, when acting for a business, authority to bind that business. You must provide accurate information, protect account credentials and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account and for managing permissions granted to team members.
3. The service
EasySyncPOS provides point-of-sale, inventory, reporting and related tools. Some functionality can continue offline and synchronize later. Offline operation does not eliminate the need to reconnect, verify synchronization status and maintain appropriate device security and backups. Features and regional availability may vary.
4. Plans, plugins and payments
The core plan may be offered free of charge. Paid plugins, subscriptions or services are identified before purchase. Prices, billing periods, taxes, renewal terms and cancellation options will be shown at checkout or in an applicable order. Payment processing may be handled by an external provider under its own terms. Unless required by law or expressly stated otherwise, fees already accrued are not refundable.
5. Acceptable use
You may not use the service unlawfully; interfere with its security or operation; access another customer’s data; distribute malware; reverse engineer protected components except where law permits; use the service to process prohibited transactions; or attempt to bypass plan, usage or access controls. You must comply with tax, receipt, consumer, employment and payment rules that apply to your business.
6. Customer data
You retain rights in data you submit to the service. You grant us the limited rights needed to host, process, transmit, secure and back up that data to provide and improve the service. You are responsible for having a lawful basis to collect and use personal data entered into EasySyncPOS and for providing required notices to your customers and staff.
7. Plugins and third-party services
Optional plugins, payment providers, hardware and third-party integrations may have separate terms, privacy notices and fees. We are not responsible for third-party services outside our control, but we will identify integrations clearly where practical.
8. Intellectual property
EasySyncPOS, its software, interface, documentation, logos and original content are owned by APDSoftware or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business operations during the applicable plan.
9. Suspension and termination
You may stop using the service or cancel a paid plan through the available account controls. We may suspend or terminate access where reasonably necessary for security, non-payment, material breach, unlawful use or protection of other users. Where appropriate, we will provide notice and a reasonable opportunity to remedy the issue. Data export and deletion are subject to the plan, technical capabilities, legal retention duties and the Privacy Policy.
10. Service warranties
We provide the service with reasonable care and professional diligence. Digital services may experience interruptions, errors or external connectivity issues. Except for rights and warranties that cannot legally be excluded, the service is provided on an “as available” basis and we do not guarantee uninterrupted availability or that every integration will remain compatible.
11. Limitation of liability
Nothing in these Terms limits liability where limitation is prohibited by law, including for fraud, willful misconduct or personal injury caused by negligence where applicable. To the maximum extent permitted by law, APDSoftware is not liable for indirect or consequential losses, loss of anticipated profit, or losses caused by customer configuration, third-party systems or failure to follow documented offline and synchronization procedures. Any contractual cap shown in an order or paid plan applies only where enforceable.
12. Changes to the service or Terms
We may update the service and these Terms to reflect new features, security needs, legal requirements or business changes. Material changes will be communicated through the service, by email or on this page with reasonable advance notice where required. Continuing to use the service after the effective date means accepting the updated Terms.
13. Applicable law and disputes
These Terms are governed by Italian law, without prejudice to mandatory rights that apply to consumers or users in another jurisdiction. Competent courts are determined by applicable law. Before starting formal proceedings, please contact us so we can try to resolve the issue.
